Richard Miserendino Appointed Deputy Chief Judge of the NLRB

Judge C. Richard Miserendino has been appointed Deputy Chief Judge in the National Labor Relations Board’s Division of Judges. He succeeds Judge Richard Scully, who has given up his administrative duties but will continue to serve as an administrative law judge with the Board.

Judge Miserendino, who has been an NLRB judge since 1996, has been serving as Associate Chief Judge in the Washington office of the Division of Judges for the past several months. Judge Miserendino received his undergraduate degree in economics from Temple University, a master’s degree from Cornell University’s School of Industrial and Labor Relations, and a law degree from Catholic University.

An independent agency created in 1935 to administer and enforce the National Labor Relations Act, the NLRB conducts secret ballot elections to determine whether employees desire union representation, and it investigates and remedies unfair labor practices on the part of unions and employers. The Judges Division, which has offices in Washington, D.C., Atlanta, New York and San Francisco, is responsible for docketing cases, conducting hearings and issuing initial decisions in unfair labor practice cases under the Act. Those decisions may thereafter be appealed to the five-member Board. The Board’s decisions are subject to review by the U.S. Courts of Appeals.
